Two actions in the Beltrami County District Court, one for personal injuries brought by Bernard Backman against Clarence Fitch; and the other for personal injuries and property damage brought by Clarence Fitch against Bernard Backman. Both actions arose out of an automobile collision between the two parties. The cases were tried together before James F. Murphy, Judge, and a jury, which returned a verdict for Bernard Backman for $12,500. The court denied Backmans motion for a new trial of his action on the issue of damages only and Fitchs motion for a new trial of his action on all issues. Each party appealed from the judgment entered in his own action, and Fitch filed a notice of review in the Backman action.
